3. REFUND_PROTOCOL
3.1 Service Delivery: NebulaMetricLabs delivers business intelligence solutions as specified in individual service agreements. All deliverables are provided digitally from our headquarters at Dag Hammarskjölds Allé 19, 2100 København Ø, Denmark.
3.2 Refund Eligibility: Refund requests must be submitted within 14 days of service delivery. Eligibility is assessed based on: (a) failure to deliver specified service metrics; (b) material deviation from agreed project scope; (c) technical issues preventing service utilization.
3.3 Non-Refundable Items: Custom development work already completed, consultation hours consumed, and third-party software licenses purchased on your behalf are non-refundable.
3.4 Refund Process: Submit refund requests to [email protected] with your contract reference. Approved refunds are processed within 30 business days to the original payment method.
3.5 Dispute Resolution: Any disputes regarding refunds will be resolved through the Danish Consumer Complaints Board or relevant EU alternative dispute resolution mechanisms.
4. TERMS_OF_ENGAGEMENT
4.1 Service Agreement: All services provided by NebulaMetricLabs are governed by individual service agreements executed between parties. These Terms of Engagement establish general conditions applicable to all services.
4.2 Intellectual Property: Upon full payment, clients receive a perpetual license to use all deliverables. NebulaMetricLabs retains ownership of pre-existing methodologies, frameworks, and tools used in service delivery.
4.3 Confidentiality: Both parties agree to maintain strict confidentiality of proprietary information exchanged during the business relationship. This obligation survives termination by 36 months.
4.4 Limitation of Liability: NebulaMetricLabs liability is limited to the total fees paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or punitive damages.
4.5 Force Majeure: Neither party shall be liable for delays or failures in performance resulting from causes beyond reasonable control, including natural disasters, governmental actions, or cyber attacks.
4.6 Governing Law: These terms are governed by Danish law, with the Copenhagen District Court having exclusive jurisdiction over any disputes.
